Kroll and Associate has informed the Supreme Court that it has executed the contract signed between it and the Office of the Senior Minister.
However, it indicated to the Apex Court that the documents relating to the contract had not been made available to the Auditor General, on the grounds that it was of confidential and national interest, therefore, was not meant for public consumption.
Kroll and Associates, again, informed the court that the documents on the contract were released to the trial for the judge’s inspection only, but copies were not served to the parties, based on the same security issue.
Yaw Oppong, lawyer for the Senior Minister, Yaw Osafo Maafo, also indicated to the seven-panel, presided over by Justice Jones Dotse, yesterday that the Auditor General’s office had been invited to the Senior Minister’s office to inspect the said documents.
But, a Director of the Legal Services Department of the Audit Service, Vincent Odikro Nyame, responded that his outfit had not received such letter inviting them to come and inspect the documents.
However, Mr Oppong insisted that the documents were available for inspection and were prepared for the Auditor General to sight and inspect it.
He said they were appealing against the surcharge, because there was evidence of work done, only that it was confidential and of national interest.
The Apex Court, in its decision, ordered its Registrar to serve an application filed by one of the parties on the others, and urged them to corporate with the appellant.
The case was adjourned sine die.
Background
The Auditor-General of Ghana has cited Yaw Osafo Maafo for causing financial loss to the state, to the tune of about GH¢5.5 million.
The Auditor-General, having conducted an audit on the accounts and other related records of the Ministry of Finance for the period between July 2017 to December 2018, found out that Senior Minister Yaw Osafo Maafo entered into an agreement with M/S Kroll Associates of the United Kingdom, on behalf of the Government of Ghana, for consultancy services in respect of assets recovery.
The agreement, which was entered into on the September, 26 2017, saw that an amount of more than GH¢4 million, which is equivalent to $1 million was paid to M/S Kroll Associates without approval from Parliament and the Public Procurement Authority (PPA).
