
The destroyed residential buildings
The Chief Executive Officer of Zoomlion, Joseph Siaw Agyapong, has overlooked two invitations by the Ghana Police Service in the aftermath of the unlawful destruction of residential property development of Turkish investors in Borteyman, a suburb of Accra by land guards and rogue elements of National Security.
The Ghana Police Service had extended invitations to Mr. Agyapong on April 4, 2025 which he ignored, prompting the Service to send him a second invitation on April 7, 2025, which was also allegedly ignored.
It is not yet clear what action the police is taking in the wake of the blatant display of disrespect exhibited by Mr. Agyapong, who has been accused of allegedly hiring land guards to destroy an over 400-unit residential development in Borteyman, properties of Arsan Group, a Turkish company.
The police, in a rather bad taste, have arrested workers of Royal Bell Investment Limited and Terraform Development Limited when they attempted to reconstruct the wall and other structures which had been unlawfully destroyed by the thugs, claiming that a petition for trespass had been filed against them.
This illogical arrest has raised questions about police integrity and concerns about how a petition of trespass could be filed against a party that has legal ownership of the land.
The arrest is further exacerbated by the fact that the police have been served with a Penal Notice filed by Royal Bell Investment Limited and Terraform Development Limited on December 5, 2023, indicating that the High Court in its judgment dated November 16, 2023 perpetually restrained Sino Africa, its workers, assigns, officers, servants etc. from entering or interfering in any manner with the disputed land.
Legal Tussle
A High Court in Accra on November 16, 2021 entered judgment in favour of Royal Bell Investment Limited, Terraform Development Limited and five others against Sino Africa Development Co. Ltd, a sister company of Zoomlion.
The judgment gave full ownership of the disputed land to Royal Bell Investment Limited, Terraform Development Limited and the others, restraining Sino Africa and its assigns from “entering, developing, occupying or interfering in any manner with the disputed land.”
Sino Africa Development Limited, dissatisfied with the decision of the High Court, challenged it at the Court of Appeal.
But the Court of Appeal, in a judgment dated March 27, 2025, in a majority decision dismissed the appeal and affirmed the decision of the High Court in favour of Royal Bell Investment Limited, Terraform and the others.
Destruction/Arrest
But in a rather unfortunate turn of events, just two days to the delivery of the judgment of the Court of Appeal, Sino Africa at midnight allegedly sent thugs and land guards to demolish walls and structures put up by Royal Bell Investment Limited and Terraform Limited on the land.
Agents for Zoomlion denied knowledge of the attacks when asked for comments.
Arsan Group also says they have reported the issue to the Turkish Embassy.
A complaint was therefore lodged at the Property Fraud Unit, where Chief Insp. Charles Twumasi and ACP Martin Appiah are, but the complainants were directed to make the complaint at the nearby Lakeside Police Station, which they did, but no action has been taken by the police to look for the perpetrators of the unlawful destruction.
The conduct of Chief Insp. Charles Twumasi and ACP Martin Appiah has since been reported to the Police Professional Standards Bureau (PPBS) for investigation and the appropriate sanctions meted out to them if found culpable.
Thuggery
A Turkish company based in Ghana, Arsan Group, has accused Ghanaian businessman Joseph Siaw Agyapong, CEO and owner of Zoomlion of allegedly using land guards and rogue elements of National Security to attack and destroy their residential property development in Borteyman, a suburb of Accra.
According to Arsan, their flagship project, which is meant to be an over 400-unit residential development in Borteyman which is meant to bring over $135 million in foreign investment into Ghana and create an excess of 1,500 jobs over the course of the development, has been fraught with repeated attacks and sabotage by persons they believe to be linked to Zoomlion and Mr. Siaw Agyapong.
Arsan Group is a Turkish company with global interest in Agriculture, Mining and Real Estate. According to a representative from Arsan, they have been operating in Ghana since 2022, after deciding to diversify their international investment portfolio to include Ghana and Angola. They since opened Arsan Ghana and have been investing in various real estate projects in Accra.
Agents for Arsan claim that over the past three years of operations in Ghana, their site in Borteyman has been attacked several times during the night by dozens of armed men, some of whom claimed during the raids to be from National Security, thereby rendering Arsan’s security services helpless to the attacks. Despite several petitions for security assistance, it allegedly seems that there is some party with obvious ‘connections’ to the country’s security agencies that are working to frustrate the project, according to them.
Arsan Group stated that they had been engaged by the bonafide owners of the land, Terraform Development Limited and Royal Bell Limited to undertake a joint venture project where they are to build some 400 residential units for Ghanaians.
After all their due diligence and being satisfied with the land ownership documents presented by the property owners, Terraform Development, they proceeded to design and construct the project.
Unfortunately, ever since the start of construction, the site has been invaded several times, with their fence wall being razed down on four separate occasions.
Despite having a legitimate title and court ordered ownership of the land, some unknown persons who repeatedly claimed that the whole area belongs to Mr. Joseph Agyapong Siaw of Zoomlion, have persistently attacked the project, most recently of which was on March 26, 2025.
