The Chief of Kade, Osabarima Agyare Tenadu II, has called on the Eastern Regional Coordinating Council (RCC) to take immediate steps to enforce the ruling of the High Court to avert bloodshed in his traditional area.
He said tension was mounting in the area as a result of unlawful activities of a rival faction that had employed unorthodox means to remove him as the duly installed chief of the area.
Addressing a news conference at his palace in Kade yesterday through his lawyer, Captain Nkrabea Effah Darteh (rtd), he said per the court’s ruling, he remained the legitimate chief of Kade and it would be unlawful for any other person to hold himself as such, and purport to undertake any form of customary rites in the area.
“I am the valid sitting legal chief of Kade. It is neither proper nor lawful for Twum Barima Otibu Asare, Yaw Berchie Darko, Ampem Yaw Danso and their followers to disturb the peace in Kade,” he emphasised.
Osabarima Tenadu explained that the Judicial Committee of the National House of Chiefs in its ruling on September 29, 2022 took a decision which was against him.
As a result, he proceeded to the Supreme Court to file a notice of appeal and followed it up with a “motion of stay of execution” at the Judicial Committee of the National House of Chiefs.
He said the legal effect of those two processes was to put ice on the decision of the Judicial Committee.
“A very interesting factor to note is that when a court gives a decision and you file an appeal, what it means is that you are inviting the appellate court to look at what happened at the court below, review it and decide whether to uphold it or change the decision thereof,” he said.
He explained that the Judicial Committee upon receiving the appeal notice ruled simpliciter that “the Appeal succeeds. Reasons to be given later.”
Nana Kadehene said it had been three years, since the committee gave its ruling but was yet to release its reason and that was disabling the Supreme Court.
In view of this, he said the rival faction that claimed victory based on the earlier ruling of the committee tried to ambush the law to one Twum Debrah to gazette anew Kadehene.
“I filed processes at the High Court in Kumasi. The High Court on October 31, 2023, gave a far-reaching comprehensive ruling granting an order of Certiorari to quash any gazatting of any one as Kadehene,” he said.
Osabarima Tenadu said he had formally informed the Inspector General of Police, Chief Justice, Attorney General, Minister for the Interior, Defence, Chief of Defence Staff, Minister of Chieftaincy Affairs, Minister of National Security, Regional Minister and the Speaker of Parliament.
He said he was for peace and would not want a single drop of blood to be shed in his area over chieftaincy.
“I want to solemnly promise that I will discharge my functions as chief without firing a bullet at anybody. I pledge my allegiance to my overload the Okyehene and loyalty to the constitution of Ghana,” he emphasised.
