
The Supreme Court on Tuesday ordered the Electoral Commission (EC) to suspend all arrangements for the re?run of the Kpandai Parliamentary election scheduled for December 30, 2025.
The five?member panel, presided over by Justice Gabriel Scott Pwamang, held that the order was necessary to prevent the EC from overreaching the Court as it considers a pending motion for certiorari.
The motion was adjourned to January 13, 2026.
The Court directed that its processes be posted at the residence of Mr. Daniel Nsala Wakpal, the 2024 National Democratic Congress (NDC) Parliamentary Candidate and First Interested Party.
It further ordered that the processes be served through his WhatsApp line, the Tamale High Court, and the Supreme Court notice boards within seven days.
Mr. Gary Nimako Marfo, counsel for Mr. Mathew Nyindam, the New Patriotic Party (NPP) Parliamentary Candidate, informed the Court on Tuesday that he had filed an ex?parte motion for judicial review in certiorari.
He said a supplementary affidavit filed on December 2, 2025, and a motion on notice for the suspension of the Tamale High Court ruling of November 24, 2025, were also before the Court.
Mr Marfo said efforts to serve Mr Wakpal had been unsuccessful, noting that bailiffs were denied access at the Chief’s Palace.
He said Mr Wakpal had therefore not been served.
The Court earlier instructed counsel to verify whether Mr Wakpal’s phone number was active by sending Mobile Money.
When GHC500 was sent, the transaction went through, confirming that the line was active.
Mr. Marfo also informed the Court that the EC had issued a press release indicating its intention to proceed with the re?run.
Mr. Justin Amenuvor, representing the EC, said he would need to confirm with the Commission whether it had the NDC candidate’s phone number or email address.
The panel expressed dissatisfaction with the response, questioning why the matter appeared to be treated as less important.
The Court noted that the EC often complained about not being informed of certain court decisions.
On November 24, 2025, the Tamale High Court ordered a re?run of the Kpandai Parliamentary election, citing widespread irregularities.
The seat is currently occupied by Mr Nyindam.
Parliament subsequently notified the EC of a vacancy in the constituency following the High Court ruling.
