Yaa Achimaa Watts, the surviving daughter of the late owner of Las Palmas Food Centre, has filed a contempt application at the High Court against the Trustees of the Assemblies of God Tabernacle of David Church, Prophet Kwasi Boateng, and Collins Owusu Adom over an alleged breach of court processes in a disputed land case.
Prophet Kwasi Boateng, Head Pastor of the Assemblies of God Tabernacle of David, is accused of continuing construction works on a disputed parcel of land at Osu in the Greater Accra Region despite a pending application for an injunction before the High Court.
In the nine-page application, filed by her lawyers, Ms. Watts contends that the respondents have deliberately disregarded the authority of the court by proceeding with development on the property while the injunction application remains undetermined.
According to the application, the disputed plot was acquired by her late mother, Mercy Obeng, from the late Evans Owusu Adom, father of the first defendant, Collins Owusu Adom, for US$730,000 or its cedi equivalent.
The plaintiff is seeking an order for the attachment and committal to prison of Prophet Kwasi Boateng for contempt of court pursuant to Order 50 Rules 1(1), (2) and (4) of the High Court (Civil Procedure) Rules, 2004. She is also asking the court to make any further orders it considers just and appropriate.
Ms. Watts argues that the second defendant is fully aware of the pending injunction application, noting that his lawyers have already filed an affidavit in opposition to the application. The suit further states that despite repeated warnings and notifications through the pastor’s legal representatives to halt construction on the disputed land, the development has continued unabated.
According to the plaintiff, the continued construction amounts to an attempt to interfere with the administration of justice and demonstrates “utter disdain and disregard” for the authority of the court.
She maintains that unless the court sanctions Prophet Boateng for contempt, he is likely to persist with the alleged acts, thereby undermining the authority and dignity of the court.
